PRACTICE AREAS

Chapter 7 Bankruptcy

Chapter 7 is a complete discharge of most unsecured debts – credit cards, medical bills, personal loans, and certain other obligations – through a court-supervised process that typically concludes in three to six months. For individuals and small businesses that have no realistic path to repaying accumulated debt, Chapter 7 provides a legal fresh start. Michael Hoverson has guided hundreds of Minnesota clients through Chapter 7 filings, helping them protect exempt assets, stop creditor harassment, end wage garnishments, and discharge debts that were making financial recovery impossible.

Chapter 13 Bankruptcy

Chapter 13 allows individuals with regular income to restructure their debts into a manageable three-to-five year repayment plan under court protection. It is the right tool for people who want to keep their home and catch up on mortgage arrears, protect a vehicle, or pay back certain non-dischargeable debts like taxes over time while stopping creditor collection actions. Unlike Chapter 7, Chapter 13 does not require liquidation of non-exempt assets, making it the preferred option for clients with property worth protecting.

Chapter 11 Bankruptcy

Chapter 11 is the restructuring chapter for businesses – and for individuals whose debts exceed the Chapter 13 limits. It allows a business to continue operating while reorganizing its obligations under a court-approved plan. Michael Hoverson represents small and mid-size Minnesota businesses in Chapter 11 proceedings, working to preserve operations, renegotiate contracts and leases, and develop a plan that allows the business to survive and repay creditors over time.

Federal Student Loan Relief

Federal student loan debt is among the most complex and misunderstood areas of consumer law. The administrative remedies available to federal borrowers – income-driven repayment plans, Public Service Loan Forgiveness, Total and Permanent Disability discharge, Borrower Defense to Repayment, and administrative discharge programs – are poorly understood by most attorneys and almost entirely unknown to borrowers themselves. Michael Hoverson has built one of Minnesota’s most specific practices in this area, representing federal student loan borrowers in navigating every available remedy and holding loan servicers accountable when they fail to apply the law correctly.

Private Student Loan Defense

Private student loans do not carry the same protections or discharge options as federal loans, but borrowers have more options than most realize. Michael Hoverson defends private student loan borrowers in collection lawsuits, pursues discharge of non-qualified private student loans in bankruptcy court, and negotiates settlements with private lenders that significantly reduce or eliminate the outstanding balance. A $400,000 student loan discharge obtained for one client – after other attorneys said nothing could be done – reflects the results that specialized knowledge in this area can produce.

CLIENT REVIEWS

I'd been shackled to a debilitating private student loan for a long time while under some tough circumstances. Despite 10yrs of on-time payments, the balance had outgrown the original amount owed. Like a lot of people, I figured there was nothing that could be done, and I was powerless in this situation.

Mike not only proved that something can be done, but that victory can be won. He assured me in our first call that every client he's had has been better off after working with him, and he delivered on that guarantee.

In my case, he was able to stop/handle all the calls/paperwork, so I didn't have to field 5 calls a day anymore. He brought the legal expertise of a lawyer who has been winning in this space for a long time, and managed to get me a settlement for $6000 less than I expected--a HUGE win. His billing was honest, he was respectful of my time, and took an incredible amount of pressure off the situation for me.

I would highly recommend Mike as a student loan expert who can handily pilot your case, and if you're in a position to try to settle a student loan debt, he knows how to work with the lenders to get things done. 5/5
Mike is very knowledgeable regarding the complexities of student loans and disability. After explaining our situation during our first phone call, we knew Mike was our guy. He told us exactly what we needed to provide him and he took it from there. He answered all our questions and kept us informed throughout the process. He did an excellent job keeping the opposing counsel updated and pushed them to remain paitient while we gathered all the information required. Getting a dismissal with Prejudice ruling in our favor was EXTREMELY stress relieving. We recommend Mike Hoverson!!
My student loans have been a nightmare for me for almost 20 years. I was under the impression like a lot of people that there is no help for private student loans so I thought there was no way out. I had already paid more than double the principle I took out and my loan servicer still demanded double the principle on top of what I had already paid.

I got my case settled with Mike for a little over 10% of what they were still demanding with no more compounding interest. I feel like I can finally pay this off and put this nightmare behind me.

Mike is the first lawyer I had ever worked with in my life. I was nervous in the beginning but he did an awesome job and I am happy with the results. I was fully expecting to have to pay more for my representation when it was over, but to my surprise, Mike said he would be issuing me a refund because we didn't use all the time for his representation I had paid for. I would definitely recommend his services if you need help.
Mike was outstanding with helping me with my case. He worked really hard for me and did a great job. Highly recommend
Mike has been assisting me with my student loans and always available for questions throughout my time working with him. He has been efficient and effective, and I truly appreciate his efforts! If you are struggling with student loans, Mike is definitely the attorney you need to call!
Mike Hoverson recently handled a lawsuit for me. Mike was a professional at every step of the process. He was very thorough at every level of the few months it took to reach a decision. He kept me informed along the way. The summary judgment ended in my favor. This was due to his excellent efforts on my behalf.
If you are looking for a knowledgeable and effective attorney to help you with your student loan issues, Mike is your guy! He has a lot of experience with student loans and he will not waste your time or money. I had an unusual situation, and within a year Mike was able to get me a settlement offer that I could not turn down. He's organized and communicative, which was very reassuring during this process. If you're having issues, give him a call - you will only regret that you didn't call him sooner!
Mike is awesome! I was at a point I felt like there was no hope, student loans were going to ruin my life. Not only did Mike tell me there was hope he delivered. Where other lawyers said nothing could be done Mike got over $400K in student loans discharged! This alone would have been enough. However, I have to mention that he was always available for me, he answered my calls, emails, and messages immediately or returned them in a timely matter. He made me feel like his #1 client through the whole process. He is an outstanding professional do not hesitate to contact him!
Mike was incredibly supportive during the phone call. After reaching out to several individuals for advice on the best course of action, Mike sincerely addressed all my inquiries. My sister also participated in the call and it was abundantly clear that he is passionate about assisting individuals with private student loans. Thank you Mike!
